Do I have a claim?

Are there any time limits for making a claim?

Yes. You have a period of 3 years from the date of knowledge in which to issue Court proceedings. In other words, you have 3 years from the day you become aware that you have an asbestos related condition in which to issue your claim at Court.

Claims can also be made after a person has died. In these cases, you have 3 years from the date of death in which to issue Court proceedings.

Will I have to pay to make a claim?

Our solicitors work on a ‘no win, no fee’ basis. If we lose, we do not charge you anything. At the outset of the case we take out an insurance policy on your behalf to protect you against any costs. If we win, we guarantee that you will keep 75% of the compensation paid to you.

 

How much compensation should I expect to receive?

Every case is different and each is assessed on its individual merits. There are often two heads of claim, general damages covering pain and suffering, and special damages which includes loss of earnings and any care costs.

 

How long is my claim likely to take?

Every case is different and the length of time needed to bring a claim to a conclusion depends on a number of factors. We aim to settle cases in the shortest time possible and have on a number of occasions completed mesothelioma claims in just 60 days.

Claims for other conditions allow Defendants 3 months to investigate the circumstances, during this time we obtain any witness evidence and medical reports we need, with a view to settling the claim as quickly as possible once the Defendant’s investigation time has elapsed.

 

Will I have to go to Court?

The vast majority of cases are settled outside of Court and so it is very unlikely that you would have to make a Court appearance.

 

Can I claim if I develop another asbestos-related condition?

There are two ways of settling a claim, on a provisional basis or on a full and final basis.

If you settle on a provisional basis, the settlement figure will be slightly lower, however, should your condition deteriorate significantly or you develop a further asbestos related condition, you will be able to claim further compensation for this.

If you settle on a full and final basis, you will receive a slightly higher settlement figure, however, you will not be able to claim again should your condition deteriorate or you develop a further asbestos related condition.

Due to the nature of the condition, mesothelioma claims are only ever settled on a full and final basis.

 

Am I entitled to any government benefits as a result of my condition?

If you were exposed to asbestos whilst in employment in the UK, you may be entitled to Industrial Injuries Disablement Benefit or a one off lump sum payment under the Pneumoconiosis Etc (Workers’ Compensation) Act 1979.

If you have been exposed to asbestos whilst self-employed, due to environmental factors such as living near an asbestos factory, or through secondary exposure such as from the clothes of a relative, you may be entitled to a payment through the 2008 Diffuse Mesothelioma Scheme.
